How to Stay Compliant When Renting Out Your Holiday Home in Andalucía

If you’re planning to rent out your property in Andalucía for short-term holiday lets, it’s important to understand the legal requirements. The region has clear rules designed to protect both owners and guests, and non-compliance can lead to fines. Below we’ve broken down the key areas every host should cover before listing their property.


1) Community & Town Hall Permissions

Before you start, confirm that your comunidad de propietarios (owners’ community) allows tourist rentals. Some urbanisations or apartment blocks prohibit them. Also check with your ayuntamiento (town hall) for any local rules—such as zoning, permits, or noise regulations—that may apply in your municipality.


2) Registering with the RTA (Registro de Turismo de Andalucía)

All holiday rentals must be registered with the RTA. You’ll need to:

  • Submit an application online via the Junta de Andalucía’s portal.
  • Provide property details, owner/operator details, and compliance declarations.
  • Once approved, you’ll receive an RTA code.

This code must be shown on all listings, websites, and advertising. From 1 July 2025, platforms like Airbnb and Booking.com will block listings without a valid NRA (Número de Registro de Andalucía).


3) Minimum Standards & Property Requirements

Your property must meet certain conditions set by the Junta de Andalucía:

  • Size: At least 25 m² total, with 14 m² per guest place.
  • Bathrooms: Sufficient bathrooms for capacity.
  • Ventilation: All bedrooms and living rooms must have direct ventilation to the outside.
  • Heating & Cooling: Fixed air conditioning in living/bedrooms for summer, heating in winter.
  • Equipment: First aid kit, basic furniture, bed linen, cleaning materials, and information about the area.

4) Guest Identity Reporting (SES.Hospedajes)

Hosts must identify all guests and report details to the Interior Ministry’s SES.Hospedajes platform. This replaced the legacy Guardia Civil Hospederías system in December 2024.

Failure to comply can result in fines. If you’re unsure, ask your gestor or solicitor to help you get set up with SES.Hospedajes.


5) Safety, Comfort & House Rules

Safety basics:

  • Smoke alarm(s).
  • CO alarm (if gas installed).
  • Fire extinguisher, accessible and checked.
  • First-aid kit.
  • Clear instructions for emergencies (dial 112).

Comfort:

  • Air conditioning & heating in living/bedrooms.
  • Good ventilation.
  • Blackout blinds or shutters for rest.

House rules:

  • Quiet hours.
  • Smoking/pets policy.
  • Rubbish & recycling days.
  • Pool safety (if applicable).
  • Neighbour respect.

Post house rules clearly in Spanish and English.


6) Pricing, Calendars & Channels

  • Calendars: Keep your availability accurate. Use iCal sync if you list on multiple platforms.
  • Minimum nights & seasons: Adjust to local demand (festivals, harvest, school holidays).
  • Direct vs platform bookings: Platforms (Airbnb, Booking.com) give reach, but direct bookings save fees—ideally use both.
  • Deposits & cancellations: Set clear, fair terms and stick to them.

7) Insurance, Tax & Paperwork

  • Insurance: Tell your insurer you’re doing holiday lets and ensure liability cover.
  • Tax:
    • Non-residents: Rental income declared via Modelo 210.
    • EU/EEA residents: May deduct certain expenses.
    • Always consult a tax adviser.
  • Tourist tax: Andalucía currently has no regional tourist tax, but check your local municipality for updates.
  • Records: Keep copies of guest ID checks, contracts, receipts, and maintenance logs.


8) Andalucía Compliance Checklist

  • Community and town-hall permission confirmed.
  • RTA registration completed and operator named.
  • Property meets minimum standards (size, bathrooms, heating/cooling, ventilation).
  • RTA code displayed on all listings; NRA prepared for platform checks (from July 2025).
  • SES.Hospedajes account set up for guest identity reporting.
  • Safety kit, house rules, and insurance updated.
  • Pricing, calendars, deposits, and cancellations clearly defined.
